Export Control Reform: Administration Publishes Changes to Regulations Controlling Exports of Military Electronics

On July 1, revisions to the Export Administration Regulations (EAR) were published in the Federal Register. 

This rule adds to the Commerce Control List (CCL) electronic equipment that the President determined no longer warrants control on the United States Munitions List (USML). It also adds development software and technology for certain wing folding systems and certain cryogenic and superconducting equipment to the CCL.

These final rules also make a number of other changes, including the addition of new ECCN 3A620 and an additional change to USML Category VIII.

With the publication of these final rules, 15 of 21 Categories of the U.S. Munitions List have been revised under the ECR process.

These Regulations streamline U.S. export controls on certain military electronics by shifting less sensitive equipment, parts, and components from Category XI of the Department of State's USML to the Department of Commerce's CCL. These changes, which are part of the President's Export Control Reform Initiative, enhance the United States' national security by increasing interoperability with their close allies and partners. These changes also reduce incentives for purchasers to deliberately avoid U.S.-origin parts and components. As a result of these changes, the United States will have greater visibility on arms transfers and end-uses of concern, including human rights abuses. The changes will take effect on December 30, 2014.
