Rules and Practice

This seminar will provide an in-depth overview of the current landscape of export control law as well as regulations and sanctions of China. Participants will gain valuable insights from industry experts and stay ahead of the evolving regulatory environment. During the seminar, key aspects such as the considerations behind the enactment of China’s Export Control Law and Regulation, the sanctions regime,  the logic driving export control supervision and enforcement under the Export Control Law (ECL) will be discussed. A focus will be on the new export control regulations on dual-use items, effective from December 1, 2024, which impose new export control obligations and penalties. Also, the new China Catalogue of Dual Use Items with Export Control Supervision Code (ECSC) will be analysed in some detail in comparison with the dual-use list under the Wassenaar Arrangement. The implications of extraterritorial jurisdiction, as well as how foreign companies are affected by these regulations will also be examined. The session will address legal liabilities and consequences related to export controls as well as imposition of sanctions as counter measures. It will also provide an update on the latest export control measures imposed by Chinese authorities in the most recent years. Participants will also gain insight into patterns of governmental investigations and risk factors that may trigger such investigations or sanctions. Finally, we will discuss the compliance dilemmas faced by companies navigating this complex regulatory environment.

Target Group

The seminar is aimed at experts from the fields of export control, sanctions, international trade, compliance, as well as company representatives and lawyers who would like to familiarise themselves with the new law and regulations of China.

Especially the new Chinese regulations in the dual-use sector and sanctions imposed by China are important for all companies that import goods from China to Germany, re-export these goods as primary or end products or hold shares in Chinese companies that could be affected by the above-mentioned restrictions. Furthermore, all companies which are mindful of the risks of national security of China and the relevance of such risks to the export controls and sanctions (counter measures) of China.
